The bond for a former Waukegan police officer charged with raping a woman in his squad car was cut in half Friday.

Even though officer Delatwan Haynes' bond was reduced from $2 million to $1 million, he is likely to remain jailed, as his attorney said Haynes' family can raise only a tenth of the cash he would need to post.

Haynes, 32, is charged with aggravated criminal sexual assault, aggravated kidnapping, aggravated criminal sexual abuse and official misconduct.

Lake County Assistant State's Attorney Patricia Fix said Haynes, who was a police officer for seven years before his resignation shortly after the incident, was on patrol during the early morning hours of Jan. 6 when he stopped the woman for jaywalking in downtown Waukegan, searched her and found a crack pipe.

Haynes gave the woman the crack pipe and told her to go home, Fix said, but encountered her again a few blocks away and ordered her into his squad car.

Fix said Haynes drove the woman to a parking lot behind a truck rental lot, had sex with her, threw a condom out of the car and drove the woman home.

The woman called Waukegan police to report what happened and returned to the lot to retrieve the condom, which Fix said has tested positive for her DNA and Haynes'.

In a response to a civil suit the woman filed against the city, attorneys for Waukegan concede the sex act took place, but claim it was consensual.

Defense attorney Jed Stone acknowledged the charges against Haynes are serious, but called a $2 million bond "Constitutionally oppressive."

Fix asked Circuit Judge Victoria Rossetti to leave the bond as it was, saying it was appropriate for a public officer charged with serious offensives.

Rossetti cut the bond in half, which would require Haynes to post $100,000 to get out of jail.

Stone said Haynes' family told him they believed they could raise $10,000 for bond.

Haynes faces up to 30 years in prison if convicted, and is scheduled to go to trial Sept. 22.

Delatwan Haynes has been acquitted of all charges and convictions as of 03/30/2011 and should not be on this forum and especially in the sex offenders section. The allegations were never true and Mr. Haynes has been trying to rebuild his reputation. Articles such as yours does an innocent man no good. Please either get rid of the article altogether or update it with the truth. Thank you

Prosecutors said Monday they may ask the state Supreme Court to review an appellate court ruling last week overturning the conviction of a former Waukegan police officer.

Delatwan Haynes, 35, has already served a two-year prison sentence he received in 2009 for official misconduct for having sex with a woman in a police car.

Haynes, who testified at his trial that the sex was consensual, was acquitted of aggravated criminal sexual assault, aggravated kidnapping and aggravated criminal sexual abuse at the end of the trial.

Haynes, who resigned from the department a short time after the complaint was made, was found guilty of official misconduct for using a squad car for personal use, leaving his assigned patrol zone and filing a false police report.

But the three-judge panel of the 2nd District Appellate Court in Elgin ruled last week that violations of police department internal policies, such as was done in the Haynes case, were not sufficient to uphold a conviction for official misconduct.

Deputy State's Attorney Jeff Pavletic said he was conferring with attorneys in the state appellate prosecutor's office about a possible appeal of the ruling.

Haynes' attorney, Jed Stone of Waukegan, said the Supreme Court has already ruled on this issue in another case.

"I doubt seriously if the Supreme Court will want to revisit this issue," Stone said. "The three-judge panel of the appellate court ruled in our favor, and if necessary, we will be prepared to fight for Mr. Haynes' innocence before the Supreme Court."
